9014-3 Motions to Continue Hearings

(a)   Timeliness. Motions to continue hearings shall be filed and orders submitted no later than 5:00 p.m. two days before the hearing, absent good cause.

(b)   Contact With Opposing Party and Parties in Interest. Motions to continue hearings shall state whether all parties entitled to notice consent to a continuance, or if all parties entitled to notice have not been contacted, the reasons the mover has not contacted them.

(1)    Motions to continue an initial chapter 13 confirmation hearing to the next available court date do not require the trustee's consent unless the trustee has filed an objection to confirmation.

(2)    All other motions to continue chapter 13 confirmation hearings shall state whether the trustee has consented, disclose pending objections, and state whether the trustee and objecting creditors have consented to the continuance.

(3)    Motions to continue all other hearings shall state whether all parties entitled to notice consent to a continuance, or if all parties entitled to notice have not been contacted, the reasons the mover has not contacted them.

(c)   Reason. Motions to continue hearings shall state the cause for the continuance.

(d)   Prior Continuances. Motions to continue shall recite the number of prior continuances.

(e)   Chapter 13 Confirmation Continuances. Motions to continue chapter 13 confirmation hearings shall be noticed to the trustee and all objecting creditors only.

(f)   Proposed Order. Mover shall contemporaneously submit a proposed order pursuant to Local Rule 9013-5.
