AMENDMENTS TO BANKRUPTCY RULES AND FORMS EFFECTIVE DECEMBER 1, 2016

There are several upcoming changes regarding the rules and forms which will impact bankruptcy practice. The amended rules and forms will be effective December 1, 2016.

The rule changes include amendments to FRCP 4(m) and FRCP 6. These changes clarify time for foreign service and eliminate the extra three (3) days after electronic service. The amendments to the Federal Rules of Bankruptcy Procedure include Rules 1010, 1011, 1012 (new), 2002, 3002.1, 7008, 7012(b), 7016(a) and (b), 9006(f), 9027, and 9033. The amendments pertain to chapter 15 procedure, chapter 13 mortgage notices, amendment of the 3-day rule, and the Stern Amendments.

The amended forms include Forms 420A (formerly 20A), 420B (formerly 20B), and 410S2. Forms 420A and 420B are being amended to conform to the numbering scheme of the Forms Modernization Project including minor wording amendments. One of the instructions in Form 410S2 is being amended to eliminate a possible inconsistency with Rule 3002.1.
